Housing Affordability Institute has released a new white paper examining MAID v. State of Montana, a March 2026 decision in which the Montana Supreme Court upheld a package of statewide housing reforms designed to expand housing supply known as the “Montana Miracle.”

The case centered on a challenge brought by Montanans Against Irresponsible Densification (MAID), which argued that the state’s 2023 housing laws violated constitutional protections tied to local land use authority and public participation. The Court rejected those claims, affirming that the Legislature acted within its authority and that the reforms were rationally related to addressing a statewide housing shortage.

The white paper is part of Housing Affordability Institute’s State Legal Precedent series, highlighting the legal precedents forming the foundation of state-level housing and development law.
