Summer is almost here, and lawmakers from across the country are turning their attention to the mid-term elections. This month’s featured highlights include updates from Colorado and Minnesota.

Colorado Lot Size Reform

After a strong start to the session with the passage of the HOME Act (HB26-1001), two similar lot size reform bills failed to progress:

• HB26-1114:Lot size reform legislation limiting minimum lot sizes over 2,000 square feet. (Passed first committee, but did not progress)
• HB26-1308: Lot size reform legislation limiting minimum lot sizes over 1,200 square feet. (Not heard)

Minnesota Passes HOA Reforms

Lawmakers in Minnesota succeeded in taking their first step into the broader land use reform effort when they passed a comprehensive HOA reform measure in the closing weeks of the North Star State’s legislative session. SF 1750 included a provision from the Stater Homes Act that bars municipalities from:

• Requiring HOAs as a condition of a development approval
• Mandating common property that forces the creation of an HOA
• Inserting terms and conditions into an HOAs governing documents

An attempt to remove this provision from the state’s failed 47-86. The House passed the bill 100-34 and the Senate passed the bill 56-9.
